{"id":763,"date":"2024-10-15T15:35:27","date_gmt":"2024-10-15T14:35:27","guid":{"rendered":"https:\/\/blogs.gov.scot\/funeral-industry\/?p=763"},"modified":"2024-10-15T15:35:27","modified_gmt":"2024-10-15T14:35:27","slug":"update-cross-border-repatriation-to-scotland-2024-amendment-regulations","status":"publish","type":"post","link":"https:\/\/blogs.gov.scot\/funeral-industry\/2024\/10\/15\/update-cross-border-repatriation-to-scotland-2024-amendment-regulations\/","title":{"rendered":"Update: Cross-Border Repatriation to Scotland \u2013 2024 Amendment Regulations"},"content":{"rendered":"<p>Our <a href=\"https:\/\/blogs.gov.scot\/funeral-industry\/2024\/09\/06\/repatriation-to-scotland-changes-to-the-medical-requirements-in-england-and-wales-cremation-application-forms\/\">blog<\/a> of 6 September 2024, about changes to the medical examiner system in England and Wales, included a reminder that any death in another UK nation must be registered before a burial or cremation can take place in Scotland.\u00a0The documents required for this are set out in the Registration of Births, Deaths and Marriages (Scotland) Act 1965 (Prohibition on Disposal of a Body without Authorisation) <a href=\"https:\/\/www.legislation.gov.uk\/ssi\/2015\/166\/contents\/made\">Regulations<\/a> 2015 (the 2015 Regulations).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The issue<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Although the requirement for deaths to be registered before burial or cremation in Scotland has been in place since 2015, the recent regulatory changes in England and Wales have brought to light that there has been some confusion over whether certificates issued by coroners can be accepted in place of certificates of registration of death.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>What\u2019s Changing<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>We advised we would review the 2015 Regulations to consider whether coroner authorisation should be accepted in Scotland to enable burial or cremation here where the death is subject to an ongoing coronial investigation in another part of the UK and where no certificate of registration of death is yet available.<\/p>\n<p>&nbsp;<\/p>\n<p>We can now confirm that <a href=\"https:\/\/www.legislation.gov.uk\/ssi\/2024\/281\/contents\/made\">an amendment<\/a> in these terms to the 2015 Regulations has been laid in the Scottish Parliament today, 15\u00a0October 2024, and will come into effect tomorrow, 16\u00a0October 2024. This change will apply to all burials or cremations which take place on 16 October 2024 onwards.<\/p>\n<p>&nbsp;<\/p>\n<p>The change to the 2015 Regulations will ensure that Scotland recognises the coroner procedures in other UK jurisdictions and avoids unnecessary delays in such cases to bereaved families arranging funerals.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Death in England or Wales<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Any burial or cremation in Scotland where the death occurred in England or Wales must not take place without:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>A Certificate of Registration of Death from the Registrar <strong>and<\/strong> a Coroner\u2019s certificate authorising removal of the body out of England or Wales,<\/li>\n<\/ol>\n<p><strong>or<\/strong><\/p>\n<ol start=\"2\">\n<li>a Coroner\u2019s certificate authorising the burial of the body,<\/li>\n<\/ol>\n<p><strong>or<\/strong><\/p>\n<ol start=\"3\">\n<li>a Coroner\u2019s certificate authorising the cremation of the body.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><strong>Death in Northern Ireland<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Any burial or cremation in Scotland where the death occurred in Northern Ireland must not take place without:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>A Certificate of Registration of Death from the Registrar <strong>or <\/strong>a Coroner\u2019s certificate authorising the burial or cremation of the body,<\/li>\n<\/ol>\n<p><strong>and<\/strong><\/p>\n<ol start=\"2\">\n<li>A Coroner\u2019s certificate authorising removal of the body out of Northern Ireland.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Our blog of 6 September 2024, about changes to the medical examiner system in England and Wales, included a reminder that any death in another UK nation must be registered before a burial or cremation can take place in Scotland.\u00a0The documents required for this are set out in the Registration of Births, Deaths and Marriages&#8230;<\/p>\n","protected":false},"author":581,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-763","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
