Our\u00a0<\/span>latest\u00a0<\/span>Scottish Procurement Policy Note (SPPN)<\/a> provides public bodies with guidance on the legal obligations which apply when devolved Scottish public bodies co-operate with reserved,\u00a0Welsh\u00a0or Northern Irish public bodies on the award of contracts.<\/span>\u00a0<\/span><\/p>\n

Since the introduction of the UK\u2019s Procurement Act 2023, the rules have changed for procurement processes carried out by reserved UK public bodies, as well as Welsh and Northern Irish public bodies. Because there are now different rules for procurement procedures across the UK, the Scottish and UK Governments have made extra legislation setting out the rules which apply when devolved Scottish public bodies co-operate with reserved,\u00a0Welsh\u00a0or Northern Irish public bodies.<\/span>\u00a0<\/span><\/p>\n

In summary the new arrangements mean that whenever a devolved Scottish public body awards a contract under a framework or dynamic market\u00a0established\u00a0under the\u00a0<\/span>Procurement Act 2023<\/span><\/a>, that Act will\u00a0largely apply\u00a0to the call-off procedure.\u00a0<\/span>However,<\/span>\u00a0when a reserved,\u00a0Welsh\u00a0or Northern Irish public body awards a contract under a framework agreement or dynamic purchasing system\u00a0established\u00a0under Scottish legislation, the Scottish legislation will\u00a0largely apply\u00a0to the call-off procedure.<\/span>\u00a0<\/span><\/p>\n
