{"id":6631,"date":"2026-06-18T09:33:20","date_gmt":"2026-06-18T08:33:20","guid":{"rendered":"https:\/\/blogs.gov.scot\/public-procurement\/?p=6631"},"modified":"2026-06-18T09:33:20","modified_gmt":"2026-06-18T08:33:20","slug":"foi-and-contractors-whats-changed","status":"publish","type":"post","link":"https:\/\/blogs.gov.scot\/public-procurement\/2026\/06\/18\/foi-and-contractors-whats-changed\/","title":{"rendered":"FOI and Contractors: What\u2019s Changed?"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.gov.scot\/publications\/foi-eir-section-60-code-practice\/\">Section 60 Code of Practice for Freedom of Information (FOI) and Environmental Information Regulations (EIR)<\/a> was updated on 25 March 2026, bringing refreshed guidance for Scottish public bodies.<\/p>\n<p>One of the key updates focuses on something many organisations deal with every day &#8211; services delivered by external or outsourced partners.<\/p>\n<p><strong>Looking beyond your organisation<\/strong><\/p>\n<p>A central message in the updated Code is straightforward: when responding to FOI or EIR requests, don\u2019t just look at the information you hold directly. The law also covers information held on your behalf. That could include information held by contractors delivering services for you.<\/p>\n<p>The revised guidance encourages authorities to take a more active approach and think carefully about whether relevant information might sit with a supplier or delivery partner, not just within their own systems.<\/p>\n<p>Two new sections in the Code add clarity on how to approach this in practice.<\/p>\n<p><strong>Information held by contractors<\/strong><\/p>\n<p>The updated guidance makes it clear that information held by a contractor can fall within scope where it relates to services being delivered on behalf of an authority. Especially where those services are part of the authority\u2019s own functions. In these situations, it\u2019s worth considering:<\/p>\n<ul>\n<li>what the contract says about information and access<\/li>\n<li>whether the information relates to delivering a public service<\/li>\n<li>and whether you need legal advice if it\u2019s unclear whether the information is \u2018held\u2019 for FOI purposes<\/li>\n<\/ul>\n<p><strong>Handling requests in practice<\/strong><\/p>\n<p>The new paragraphs also reinforce the purpose of FOI law to provide transparency about public services, however they are delivered. That means when a request comes in, authorities should consider <strong>whether the contractor be holding relevant information on our behalf?<\/strong><\/p>\n<p>If the answer might be yes, particularly where the contractor is delivering a service the authority is responsible for, then the authority may need to go to the contractor to get that information in order to respond. Importantly, the responsibility doesn\u2019t shift &#8211; <strong>it remains the authority\u2019s duty to comply with FOISA and the EIRs.<\/strong><\/p>\n<p>The Code also points to Commissioner Decision 094\/2013 as a useful example of how these relationships can be interpreted.
