Burial Regulations Guidance Published and Minor Updates Made to Burial Application Forms

The Scottish Government has today (17 February) published guidance in support of The Burial (Applications and Register) (Scotland) Regulations 2024 and The Burial (Management) (Scotland) Regulations 2025 which will come into force on 1 March 2025.

This guidance aids understanding of what the regulations do, what the legal requirements are and what is not permitted.

Burial application forms

Following publication of the new burial application forms on 11 February, the team have been working to address some issues brought to our attention.

Firstly, the burial authority logo on the first page which originally defaulted to ‘visible but not printable’ has been changed to enable printing.

Secondly, the size of the address box on the first page has been increased to ensure adequate space for a full address to be entered.

In relation to adding signatures, it is understood that the instructions on “fill and sign” lead to the document being locked after first signature by the applicant, preventing further text/signatures to be added by the funeral director or burial authority.

To avoid this, applicants can be advised to “draw freehand” a signature in Adobe which does not lead to the document being locked for others.

The amended forms and alternative instructions for signing the forms, will be uploaded to the SG webpage in the coming days. Burial: statutory forms – gov.scot.
