Consultation on the Regulations and Orders Associated with the Public Bodies (Joint Working) (Scotland) Act 2014

The draft Scottish Statutory Instruments which will accompany the Public Bodies (Joint Working) (Scotland) Act 2014 will go out for consultation in two stages. These have been developed in collaboration with stakeholders.
Stage one of the consultation is now available
Consultation Approach/Timeline
These two stages of consultation will enable our stakeholders to comment on the larger package of Regulations, before the small regulation changes, which underpin the overarching policy, become available two weeks later. You will have access to comment on the full package of regulations for ten consecutive weeks during the consultation.
Draft Regulations: Set 1
Monday 12 May 2014 – Friday 1 August 2014
Consultation on the first set of draft Regulations will run for twelve weeks from Monday 12 May 2014 – Friday 1 August 2014 and will cover draft Regulations relating to:
- Prescribed information to be included in the Integration Scheme – Section 1(3)(f)
- Prescribed functions that must be delegated by Local Authorities – Section 1(7)
- Prescribed functions that may or that must be delegated by a Health Board – Section 1(6) &1(8)
- Prescribed National Health and Wellbeing Outcomes – Section 5(1)
- Interpretation of what is meant by the terms health and social care professionals – Section 69(1)
- Prescribed functions conferred on a Local Authority officer – Section 23(1)
Draft Regulations: Set 2
Tuesday 27 May 2014 – Monday 18 August 2014
Consultation on the second set of draft Regulations will run for twelve weeks from Tuesday 27 May 2014 – Monday 18 August 2014and will cover draft Regulations and Orders relating to:
- Establishment, membership and proceedings of the joint monitoring committee in lead agency arrangements – Section 17(1)
- Membership, powers and proceedings of integration joint boards in body corporate arrangements – Section 12(1)
- Prescribed groups which must be consulted when drafting integration schemes, prescribed consultees for draft strategic plans, prescribed consultees for localities, prescribed consultees for revised integration schemes – Section 6(2)(a), Section 33(6), Section 44(4), Section 46(4)(a)
- Prescribed membership of strategic planning groups – Section 32(2)
- Prescribed form and content of performance reports – Section 42(3)
Consultation Process/How to Respond to the Consultation
Consultation is an essential and important aspect of Scottish Government working methods and this exercise aims to provide opportunities for all those who wish to express their opinions on the draft Regulations to do so in ways which will inform and enhance the development of the regulations before they are implemented.
We are inviting written responses to this consultation paper using the respondent information form and consultation questionnaires which can be found at Annex 1- 6 within the consultation paper. If you have an interest in a particular part of the legislation, you can respond on individual sets of regulations rather than the suite of regulations in its entirety.
Responses are required by:
- Set 1 – Friday 1 August 2014
- Set 2 – Monday 18 August 2014
