Living Wage Week 2022

As Living Wage Week has rolled round again, we are reflecting on the 12 months since last year’s announcement on supporting fair work practices in public sector contracts.

Since then, we have published statutory guidance which includes a new chapter titled Fair Work First requirements in procurement. The update reflects development of the Scottish Government’s policy on Fair Work First (FWF), including payment of the real Living Wage and its application within Scottish public procurement. This delivered on one of the recommendations made by the Fair Work Convention’s Construction Inquiry:

Recommendation 5: Guidance should be updated to make clearer the connections between fair work, sustainable procurement duties, community benefits and discretionary and mandatory exclusions. The guidance should support more use of discretionary exclusions when a contractor or sub-contractor has breached its labour law obligations.

All of our National Collaborative Framework Agreements now include a requirement for suppliers to pay staff involved in the delivery of goods, works and services under the framework agreement, at least the real Living Wage.  Recently issued ‘Invitation To Tenders’ (ITTs) mandating the real Living Wage and including the FWF criteria:
