New Construction Policy Note (CPN) 2/2021

We have published a new Construction Policy Note (CPN) confirming Scottish Government’s support for the principle of avoiding conflict in construction contracts.
It elaborates on the existing guidance in the Construction procurement: project initiation and business cases handbook, highlighting the need for early recognition and intervention to address differences of opinion in construction contracts. While also helping to identify the key factors and help broker mutual recognition, understanding and agreement to avoid matters escalating into disputes.
It also clarifies that a conflict avoidance approach should be implemented where possible in order to ensure project success through trust, collaboration and co-operation.
We are pleased to acknowledge the ongoing work of RICS Scotland under the auspices of the Conflict Avoidance Coalition Steering Group to make Employers, contractors and consultants aware of the benefits of adopting an appropriate conflict avoidance approach in construction contracts.
